Terms of service
Last updated: 2026-10-11
Version dated 2026-10-11
§ 1 Provider, scope, definitions
- Normaro is offered by Raman Navarych, owner Raman Navarych, ul. Jerzego Holzera 6 lok. 112, 02-972 Warszawa, Poland, registered in the Polish central register of business activity (CEIDG), NIP 9512577983, REGON 526409740, email hello@normaro.eu (“we”).
- These terms of service govern the use of the website normaro.eu, the customer account, the free quick check and the paid checks (together the “Service”). They are also the terms and conditions (regulamin) within the meaning of Article 8 of the Polish Act on the Provision of Services by Electronic Means.
- Definitions:
- Customer means anyone who uses the Service.
- Consumer means a natural person who concludes a contract with us that is not directly connected with their business or professional activity (Article 221 of the Polish Civil Code).
- Business customer means anyone who concludes the contract in the exercise of their commercial or independent professional activity.
- Business customer with consumer rights means a natural person who concludes a contract directly connected with their business activity, where the contract is not of a professional nature for that person (Article 3855 of the Polish Civil Code). That person has the rights under § 12 and § 13 and the protection against unfair contract terms in the same way as a consumer.
- Check means the automated examination of selected pages of a website for accessibility or for obligations under the AI Act; report means its result.
- Quick check means the free, shortened check of the home page.
- Deviating terms of business customers do not apply, even if we do not object to them.
§ 2 Paddle as reseller
- Our online reseller Paddle.com Market Limited (“Paddle”) conducts our order process. Paddle is the Merchant of Record for all our orders: you conclude the purchase contract for a check with Paddle, and Paddle accepts the payment, charges the VAT, issues the invoice and handles refunds. Paddle's buyer terms (paddle.com/legal/checkout-buyer-terms) also apply to the purchase.
- We perform the check and are responsible for its content. These terms of service govern the use of the Service and the content of the service provided.
- Send questions about payment, invoices and refunds to Paddle via paddle.net or to us; we forward them.
§ 3 Services
- Accessibility check. Automated check of the selected pages against the success criteria of WCAG 2.2 at Level A and AA, mapped to clause 9 of the harmonised standard EN 301 549, with tests for keyboard operation, focus, zoom, reflow, contrast and target sizes, and a general assessment of whether Directive (EU) 2019/882 (European Accessibility Act) could apply to the offering. In addition, at no extra charge, the report shows the results for the Level AAA success criteria; this level is not required by law, and these results are provided for information only.
- AI Act check. Automated check of the selected pages for publicly recognisable features that may be relevant to the transparency obligations under Article 50 of Regulation (EU) 2024/1689 and to Annex III to that Regulation, and for selected points of the GDPR (privacy policy) and of Directive 2002/58/EC (scripts before consent).
- Report. Each check produces a report in the customer account and as a PDF file in the selected language (German, English, Spanish, French, Italian, Polish or Russian). For each finding, the report states the criterion, the location and the source.
- Normative status. We check against the version of the legal acts and standards in force on the day of the check; the report states this version. Later changes to law, standards or the practice of authorities are not the subject of a report already produced.
- Quick check. The quick check automatically checks only the home page and shows an overview of the results without locations and instructions. It is available to registered customers once per website and no more than three times per calendar month. There is no entitlement to the quick check; we may change or discontinue it.
- Not owed are: a full audit by experts, a manual check, the remediation of defects, legal advice, a certification, a test seal, and an assurance that a website meets legal requirements or that authorities or courts will assess it as compliant.
- Functionality and interoperability. The report is displayed in the account as a web page and provided as a PDF file without copy protection that opens in common PDF programs. The check is a one-off service; we do not owe updates to a report once provided; we remedy defects under § 13.
§ 4 Significance of the results
- A check is an automated snapshot of the pages at the time of retrieval. Content that changes afterwards, that is visible only after login, after consent, in certain countries, browsers or variants, or that blocks retrieval by programs may differ or be missing.
- The results mean:
- Violation: The automated test found a deviation from the criterion.
- Check manually: The criterion cannot be conclusively assessed automatically; a human must check it.
- No violation found: The automated test found no deviation. This does not mean that the criterion is met.
- Not applicable: The page has no content to which the criterion applies.
- Only humans can conclusively assess many WCAG criteria. A report without violations is therefore not proof of accessibility.
- An AI model generates parts of the report, in particular the summary, the prioritisation and the remediation guidance, on the basis of the measurement results; the report labels these parts as AI-generated, and they may contain errors. If an AI-generated text contradicts a measurement result, the measurement result prevails.
- Assessments of whether legislation applies (European Accessibility Act, AI Act, GDPR, ePrivacy Directive) are based solely on publicly visible features of the website. They are general, non-binding information and not legal advice in an individual case. We are not a law firm, nor a conformity assessment body, notified body or market surveillance authority within the meaning of Directive (EU) 2019/882 or Regulation (EU) 2024/1689. For a binding assessment, contact a lawyer.
- You decide on your own responsibility which measures you take on the basis of a report.
§ 5 Technical requirements
To use the Service, you need an internet-enabled device with an up-to-date browser (the two most recent major versions of Chrome, Edge, Firefox or Safari) with JavaScript and cookies enabled, and an email address. For PDF reports, you need a program that displays PDF files. Using the internet involves general risks, such as malware or unauthorised access; protect your device and your access credentials.
§ 6 Customer account
- You need an account for the quick check and for orders. You register with an email address and password or with a Google account and accept these terms of service when you do so. Registration concludes the contract for the use of the account; this contract is free of charge and of indefinite duration.
- Only persons aged 18 or over with full legal capacity may create an account; the Service is not directed at minors. Anyone acting for a business warrants that they are authorised to do so.
- Keep your details up to date and your access credentials secret. If you notice misuse, write to us immediately.
- You may terminate the contract at any time without notice by deleting your account in the account settings or by writing to us.
- We may terminate the contract by email with 30 days' notice if we discontinue the Service or if the account has not been used for 24 months. In the event of a serious breach of § 9, we may block the account and terminate the contract without notice after we have told you the reason and, where possible, given you an opportunity to comment.
- We perform checks already paid for even after we terminate, or we refund the price; in the case of termination for a serious breach of § 9, this does not apply to the check to which the breach relates.
- After the contract ends, we delete the account and the reports. Save any reports you want to keep as PDF beforehand.
§ 7 Order, prices, conclusion of the contract
- The price per check is €6 for the first page and €1 for each additional page. Accessibility and AI Act are separate checks. All prices are final prices including VAT. The total price shown before the order is binding.
- The order process: you enter the address of the website, select pages, checks and language, see an overview with the total price, give your consent under § 12(3) and reach Paddle's payment form. Until you submit the order, you can review and correct all details.
- By clicking the button for an order with an obligation to pay in the payment form, you make a binding offer. The contract is concluded when Paddle confirms the payment. We confirm the contract, including your consent under § 12(3), by email.
- Paddle determines the payment methods. Paddle issues the invoice; you receive it by email.
- We do not store the contract text separately. You can access and save the terms of service currently in force on the website at any time; you can see the data of your order in your account.
- We may change prices for future orders. For orders already paid for, the price at the time of the order applies.
§ 8 Performance
- We start the check as soon as the payment is confirmed and you have consented to immediate performance. A check usually takes about one minute per page; the report is available no later than 48 hours after the order.
- We access only publicly accessible pages, as a visitor would, with a limited number of requests and with an identifier that identifies us as a checking service. We do not circumvent access restrictions such as logins, paywalls or CAPTCHAs.
- If a page is unreachable or blocks automated retrieval, we try again. If the check of a paid page fails, we refund the amount attributable to that page or repeat the check, at your choice.
- Reports remain available in your account until you delete them or the account. We do not owe permanent archiving.
§ 9 Your obligations and permitted use
- Only have websites checked that belong to you, that you manage on behalf of the owner, or that may otherwise lawfully be checked.
- In particular, the following is not permitted:
- unlawful content in inputs and profile details,
- circumventing access restrictions, blocks or limits of the Service,
- orders intended to overload third-party servers,
- automated access to the Service without our consent, except through interfaces we offer,
- disclosing access credentials to third parties.
- To protect third-party websites and the Service, we may limit the number of pages and checks per period.
- Business customers, except business customers with consumer rights, indemnify us against third-party claims based on a breach of paragraph 1 or 2 for which they are responsible, including reasonable costs of legal defence.
- We check websites of public authorities and other public bodies only after you have expressly confirmed in the order process that you are authorised to have them checked.
- The Service is not offered to persons, entities and territories subject to sanctions or embargoes of the European Union, the United Kingdom or the United States, in particular not to persons and entities established in Russia or Belarus (Regulations (EU) No 833/2014 and (EC) No 765/2006), and not to persons on a sanctions list. By ordering, you warrant that this does not apply to you. If performance would breach sanctions law, we may refuse or cancel an order; we refund amounts already paid to the extent the law permits.
§ 10 Rights in reports and in the Service
- You receive a non-exclusive right, unlimited in time and territory, to use and reproduce the report for your own purposes and to pass it on to the owner of the checked website or to your clients.
- You may not present a report as a certificate, expert opinion or confirmation of conformity, may not remove the notice of the automated check or the labelling of AI-generated parts, and may not use Normaro as a test seal.
- The software, texts, design and trademark of the Service belong to us or our licensors. Cited standards and legal texts are subject to the terms of their publishers (W3C, European Union).
§ 11 Availability and further development
- We strive for high availability but do not owe uninterrupted accessibility. Maintenance, security updates and disruptions at third parties (hosting, payment, networks) may temporarily restrict the Service.
- We may develop the Service further, extend checks and change how reports are presented. This does not affect the scope of checks already paid for.
§ 12 Right of withdrawal
- Consumers and business customers with consumer rights have a statutory right of withdrawal of 14 days. The withdrawal information sets out the details and the model withdrawal form.
- You can declare withdrawal by email, using the form or using the “Withdraw from contract” function in your account.
- The right of withdrawal expires when we have fully performed the check and began it only after you expressly consented to our beginning before the end of the withdrawal period and acknowledged that you lose your right of withdrawal upon full performance. You give this consent in the order process by ticking a separate checkbox that is not preselected.
- If you withdraw after we began the check at your request but before it has been fully performed, you pay the share of the price attributable to the pages fully checked by the time your withdrawal reaches us; the withdrawal information explains the calculation. We refund the rest within 14 days via Paddle.
§ 13 Defects and complaints
- We are liable in accordance with the statutory provisions for the check and the report conforming to the contract (for consumers: Article 43h et seq. of the Polish Consumer Rights Act).
- Send complaints to hello@normaro.eu or through your account. Please state the report, the problem and what you request (for example a repeat check or a refund). If the information is incomplete, we ask you for the missing details.
- We reply by email within 14 days of receipt. If we do not reply to a consumer within this period, the complaint is deemed accepted (Article 7a of the Polish Consumer Rights Act).
- If the service is defective, we perform the check again. If this fails or is unreasonable, we refund the price in full or in part.
§ 14 Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law, within the scope of a guarantee we have given, and in all cases in which the law does not permit a limitation of liability.
- In the case of slight negligence, we are liable only for breach of essential contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may rely, and only for the damage typical for the contract that was foreseeable when the contract was concluded.
- Towards business customers, liability under paragraph 2 is limited per incident of damage to the price of the order concerned; towards business customers, we are liable for lost profit and indirect damage only under paragraph 1.
- For free services (website, account, quick check), we are liable only under paragraph 1.
- A report contains no assurance of conformity (§ 3(6)). We are therefore not liable for the checked website meeting legal requirements, and not liable for fines, warning letters, orders or third-party claims directed against the operator of the website, unless they are based on a breach of duty for which we are liable under paragraph 1.
- Towards consumers and business customers with consumer rights, paragraphs 2 to 5 apply only to the extent that mandatory law does not preclude this.
- The limitations also apply to the personal liability of our employees and agents.
- For customers whose habitual residence or place of business is outside the European Economic Area, Switzerland and the United Kingdom, the following applies in addition, to the extent mandatory law does not provide otherwise: THE SERVICE AND THE REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. OUR TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH AN ORDER IS LIMITED TO THE PRICE OF THAT ORDER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS, LOSS OF DATA OR BUSINESS INTERRUPTION. If the law of your state does not allow some of these exclusions, they apply to the extent it permits.
§ 15 Force majeure
We are not liable for delays and failures caused by events beyond our control (for example natural events, war, official orders, large-scale failures of networks or data centres). If such an event lasts longer than 30 days, either party may withdraw from the affected contract; amounts already paid for checks not performed are refunded.
§ 16 Data protection
The privacy policy explains how we process personal data. We process the content of the checked pages only to perform the check.
If you have third-party websites checked for your clients, you are responsible for being authorised to do so. For retrieving and evaluating publicly accessible pages, we are an independent controller (Article 4(7) GDPR) and not your processor; we do not conclude data processing agreements for checks.
§ 17 Changes to the terms of service
- We may change these terms of service for a valid reason: changes in legislation or case law, orders from authorities, new or changed functions of the Service, security reasons, or changed terms of Paddle.
- We notify account holders of changes by email at least 14 days before they take effect. If you do not agree, you can delete the account before then. Orders already paid for are governed by the terms of service that applied at the time of the order.
§ 18 Communication
We make declarations concerning the contract by email to the address of your account or in the account. You can reach us at hello@normaro.eu. We send confirmations under § 7(3) on a durable medium (email).
You agree that we conclude contracts electronically and send you all declarations, confirmations and invoices electronically; electronic documents are equivalent to paper documents. As long as you have an account, you must provide a working email address. A declaration is deemed received once it has been sent to the address of your account and you could retrieve it under normal circumstances.
§ 19 Language
- These terms of service are available in German, English, Spanish, French, Italian, Polish and Russian. The contract language is the language in which you order. For consumers and business customers with consumer rights resident in Poland, the contract language is Polish; they also receive the terms of service and the confirmation under § 7(3) in Polish.
- If language versions differ, the English version prevails towards business customers; towards consumers, the version in the contract language applies.
§ 20 Out-of-court dispute resolution
- We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If you have a problem, write to us directly; we will look for a solution.
- Irrespective of this, consumers may contact advisory bodies: in Poland, the municipal and district consumer ombudspersons (miejski or powiatowy rzecznik konsumentów) and the Trade Inspection (Inspekcja Handlowa); in other EU Member States, the European Consumer Centre of their country (ECC-Net).
§ 21 Applicable law and jurisdiction
- Polish law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers habitually resident in another state retain the protection of the mandatory provisions of that state (Article 6(2) of Regulation (EC) No 593/2008, Rome I Regulation).
- The courts at the consumer's domicile have jurisdiction over actions against consumers; consumers may also bring actions there (Articles 17 and 18 of Regulation (EU) No 1215/2012).
- The place of jurisdiction for disputes with business customers is the competent court in Warszawa, Poland.
- Consumers habitually resident outside the European Union also retain the protection of the mandatory consumer protection provisions of their state of residence.
- Polish law and the place of jurisdiction under paragraph 3 also apply to business customers established outside the European Union. We may also sue business customers at their general place of jurisdiction.
§ 22 Final provisions
- If a provision of these terms of service is invalid, the remainder remains valid; the statutory provisions replace the invalid provision.
- We send you earlier versions of these terms of service on request.
- We may transfer our rights and obligations under the contract to a successor who continues the Service. We notify you by email at least 30 days in advance. Consumers and business customers with consumer rights must consent to the transfer; if they do not consent, they may terminate the contract. Checks already paid for are performed or refunded.
